কিন্তু রাজশাহীর কোন উপজেলা রেজিষ্ট্রি অফিসেই এ সকল সহকারীদের বিরুদ্ধে তাদের আইন ভঙ্গের জন্য টাউট আইন মামলা হয়েছে এখন পর্যন্ত এমন কোন নজির পাওয়া যায়নি। রেজিষ্ট্রি আইনে ২৯০জি ধারায় রয়েছে একজন দলিল লেখক কি পরিমান বা কত টাকা পারিশ্রমিক পাবেন, বর্তমানে প্রতি ৩শ শব্দ বা তার অংশ বিশেষের জন্য দলিল লেখকদের পারিশ্রমিক ধার্য ৬/৮ টাকা।
অথচ রাজশাহীর কোথাও কোন সাব-রেজিষ্ট্রি অফিসেই আইন মোতাবেক দলিল লেখকগন পারিশ্রমিক নেন না। তারা নিজেরাই রেজিষ্ট্রি অফিসকে ঘিরে একটি মনগড়া রেট তৈরী করে অধিক টাকা দলিল রেজিষ্ট্রি খরচ আদায় করে নিচ্ছেন।
এই রেটের বাহিরে কোন ভুমি মালিকদের জমির দলিল লেখা হয় না। অথচ সরকারী নিয়ম অনুযায়ী অর্থাৎ রেজিস্টেশন সাব গ্রহনের ২০২ অনুচেছদ মোতাবেক সাব-রেজিষ্ট্রারগন ব্যাক্তিগত ভাবে জমির ক্রেতার কাছ থেকে নির্ধারিত ফি গ্রহন ও তার বিপরীতে রশিদ প্রদান করবেন। কয়েকটি সাব-রেজিষ্টার অফিসে খোজ নিয়ে জানা গেছে কোন সাব-রেজিস্টারই ব্যাক্তিগত ভাবে জমি ক্রেতার কাছ থেকে ফি নেন না।
কিংবা রশিদও দেন না। এই কাজ গুলো করেন দলিল লেখকরা (মুহরীরা) তারা জমি ক্রেতার কাছ থেকে সাধারনত দু-ভাবে টাকা আদায় করে থাকেন। এক দলিল প্রতি চুক্রি ভিত্তিক টাকা আদায় বা মোট জমির মূল্যের উপর ধার্য করা হয় এবং বিভিন্ন খাতের নাম করে আদায় করা হয়। ক্রেতার কাছ থেকে এই টাকা গ্রহন করে তারা সাব-রেজিষ্ট্রি অফিসে জমা দেন। টাকার সেই অংশটি বা সরকারী ভাবে ধার্য্যকৃত আর অতিরিক্ত টাকা ভাগাভাগি হয় দলিল লেখক ও সংশিষ্ট কর্মকর্তাদের মধ্যে।
এছাড়া জমির অব-মূল্যায়ন সংক্রান্ত অসংখ্য অভিযোগের পর ১৯৯১ সালে আই জি আর মহা পরির্দশক নিবন্ধন এক অফিস নির্দেশে (স্বারক নং ৭০৭৬২৬০০ তাং ২৮/০৫/৯১ উলেখ করেছেন যে, জমি অব-মুল্যায়িত হয়েছে এটা বুঝতে পারলে সাব-রেজিষ্টারগন কালেক্টরকে (জেলা প্রশাসক) জানাবেন এরপর কালেক্টর অর্থাৎ জেলা প্রশাসক জমির ক্রেতাকে নোটিশ দিয়ে প্রকৃত মুল্য অনুযায়ী রাজস্ব বা দলিল ষ্ট্যাম্প জমা দিতে বলবেন।
কিন্তু রাজশাহীর উপজেলা সাব-রেজিষ্টার অফিস গুলোতে জমির অব-মূল্যায়ন সংক্রান্ত আই জি আর মহা পরির্দশক নিবন্ধন এর এ অফিস নির্দেশ মোতাবেক খুব কম সংখ্যক অভিযোগ সহ কালেক্টরের কাছে দেওয়া হয়, যাতে অবমূল্যায়নের মাধ্যমে ক্রয় করা জমির মালিককে পুনরায় রাজস্ব দেয়া লাগে। সাব রেজিষ্ট্রার গন জমির মূল্য নির্ধারন করে থাকেন মনগড়া ভাবে। এ ক্ষেত্রে দলিল লেখকগনও তাদের সাহায্য করেন নিজেদের আসল উদ্দেশ্য হাসিলের জন্য। এমন কোন সুনির্দৃষ্ট আইন নেই যে কত দিন পর জমির মূল্য বৃদ্ধি করতে হবে। কিন্তু বাস্তবতা এই যে, প্রতি বছরই জমির মূল্য বৃদ্ধি পায় শহর ও গ্রামাঞ্চলে।
অথচ সা-রেজিষ্ট্রারগন ৫বছর দ্বিগুন হারে জমির মূল্য নির্ধারন করছে এর নজির পাওয়া যায়নি। জানা গেছে একটি দলিল লেখার জন্য সর্বনিম্ন ৪শত ও সর্বোচ্চ এক হাজার শব্দ লাগে। নিয়ম অনুযায়ী প্রতি ৩শত শব্দ বা তার অংশ বিশেষের জন্য ৬/৮ টাকা পারিশ্রমিক হলে জমির ক্রেতাকে এ বাবদ কত টাকা ব্যয় করা হয় তা স্পষ্ট।
কি সমিতির মাধ্যমে দলিল লেখকরা মনগড়া অর্থ আদায় করে দুই তিন গুন। রাজশাহী জেলার কোন কোন উপজেলা দলিল লেখক সমিতি টাকা আদায়ের ছাপানো ফরমের বিষয়টি এখানে উলেখ করা যায়। এই ফরমে ১০হাজার টাকার জমি কিনতে হলে ক্রেতাকে যে অর্থ দিতে হয় তার হিসাব রয়েছে। যেমন ষ্ট্যাম্প খরচ ১হাজার টাকা, হলফনামা ৪০টাকা, রেজষ্ট্রেশন ফি ৪০৮টাকা, অফিস খরচ ৩০টাকা, রশিদ লেখা ৩টাকা, মসজিদের চাঁদা ১০টাকা, দলিল লেখক সমিতির চাঁদা ৩০টাকা, থানা ২হাজার ১শত টাকা, পৌরসভা ২হাজার ৭শত টাকা সর্বমোট ৬হাজার ৩শত ২৪টাকা।
একজন ক্রেতাকে দিতে হয় মাত্র ১০হাজার টাকার জমি কিনলে অর্থাৎ সাব-রেজিষ্ট্রারের অধিন সাব-রেজিষ্ট্রি অফিসে একজন ক্রেতাকে দলিল সম্পন্ন করতে হলে ক্রয়কৃত জমির মোট মূল্যের ৬৩শতাংশ ব্যয় হয়। কিন্তু সরকারী আইন অনুযায়ী কোনক্রমেই ২০শতাংশ ছাড়িয়ে যাবার কথা নয়। প্রকৃত খরচ হলো ১০হাজার টাকার জমিতে ১হাজার টাকার ষ্ট্যাম্প খরচ সর্বোচ্চ, হাজারে ৫টাকা হারে ৫০০টাকা রেজিষ্ট্রেশন ও হলফনামা ৩০টাকা, দলিল লেখকদের পারিশ্রমিক কোন ক্রমেই ৫০টাকার বেশী হবার কথা নয়। এছাড়া পৌর এলাকায় জমি ক্রয়-বিক্রয় হলে পেইট ট্যাক্স দিতে হয় শতকরা ৬ টাকা হারে। আর গ্রামাঞ্চলে হলে ইউনিয়ন পরিষদ এবং জেলা পরিষদে শতকরা ২ টাকা পাবার কথা ।
সাব-রেজিষ্ট্রি অফিসগুলোতে দলিল লেখকদের হিসাবে বেশী রেটে দলিল রেজিষ্ট্রি করা হচ্ছে। এতে করে জমির মূল্য কম করে দেখানোর ঘটনা প্রতিটি রেজিষ্ট্রি অফিসেই ঘটছে হর হামেশা। এছাড়া ৮০ধারা অনুযায়ী দলিল লেখকদের নামের তালিকা ও তাদের পারিশ্রমিক হার একইভাবে টাঙ্গিয়ে রাখার নির্দেশ থাকলেও রাজশাহীতে কোন সাব-রেজিষ্ট্রি অফিসে এ তালিকা টাঙ্গানো হয়না ।
বিভিন্ন সাব-রেজিষ্ট্রি অফিস ঘুরে জানা গেছে সাব-রেজিষ্ট্রার ও দলিল লেকক সমিতির যোগসাজসে অবৈধ উৎকোচের বিনিময়ে জমির মূল্য কম বেশি দেখিয়ে অধিক রেটে জমি রেজিষ্ট্রি করার ফলে একদিকে জনগন নানাভাবে হয়রানী ও ক্ষতিগ্রস্থ হচ্ছে অন্যদিকে সরকার কোটি কোটি টাকা রাজস্ব আয় থেকে বঞ্চিত হচ্ছে।

অপর দিকে সরকার দূর্নীতি রোধে আইন প্রনয়ন সুপারিশের যে উদ্দোগ নিয়েছিলেন তা হলো সাব-রেজিষ্ট্রার গন নয় বরং দলিল রেজিষ্ট্রি করার সম্পন্ন করানোর দায়িত্ব পালন করবেন প্রতিটি থানার সহকারী কমিশনার (ভূমি)-এসিল্যান্ড এবং দলিলের বদলে থাকবে ছাপা ফরম।
তথাকতিথ দলিল লেখক সমিতি জনগনকে জিম্মি করে তাদের বেধে দেওয়া রেট অনুযায়ী জমি রেজিষ্ট্রি করতে যেমন বাধ্য করছে তেমনি জমি রেজিষ্ট্রিতে প্রকৃত মূল্য না লিখে কম বেশি মূল্যে জমি রেজিষ্ট্রি করায় দলিল লেখকেরা রাতারাতি আঙ্গুল ফুলে কলাগাছ হলেও সরকার জমি রেজিষ্ট্রির খাত থেকে কোটি কোটি টাকার রাজস্ব আয় থেকে বঞ্চিত হচ্ছে বলে অভিজ্ঞ মহলের ধারনা।
