প্রধান নির্বাচন কমিশনার, রিটার্নিং কর্মকর্তা, গাইবান্ধার ডিসি, জেলা নির্বাচন কর্মকর্তাকে রিটে বিবাদী করা হয়েছে।
আইনজীবী ইউনুছ আলী আকন্দ বলেন, সংবিধানের ১২৩(৪) অনুচ্ছেদে বলা হয়েছে, আসন শূন্য ঘোষণার ৯০ দিনের মধ্যে নির্বাচনের তফসিল ঘোষণা করতে হবে। এটি না হলে পরবর্তী ৯০ দিনের মধ্যে আবারো তফসিল ঘোষণা করতে হবে। অথচ এখানে পুনরায় তফসিল ঘোষণা না করে নির্বাচন কমিশন ২৬ ডিসেম্বর একটি পত্র দিয়ে আগামী ৪ জানুয়ারি নির্বাচনের তারিখ ঘোষণা করেছে। যা সংবিধানের ১২৩(৪) অনুচ্ছেদের লঙ্ঘন। এটি আরপিও ১৯৭২-এর লঙ্ঘন বলেও জানান তিনি।
বৃহস্পতিবার (২৯ ডিসেম্বর) বিচারপতি মো. নজরুল ইসলাম তালুকদার ও বিচারপতি বিশ্বজিৎ দেবনাথের বেঞ্চে রিট আবেদনটির ওপর শুনানি হতে পারে।
